The Commercial Litigation Department at Hunt Leibert represents a significant and diverse group of banks, institutional lenders, servicers, small businesses and individuals in a wide variety of complex commercial proceedings in all of Connecticut's State and Federal Courts. Our team offers practical and cost effective strategies, coupled with vigorous and efficient prosecution and defense, which has led to optimal results for our clients in the following areas: Creditors Rights: This portion of the Commercial Litigation Department's practice focuses on commercial foreclosures, contested residential foreclosures, appointment of receivers, prejudgment attachments, and the defense of various borrower claims under the Fair Debt Collection Practices Act (FDCPA), the Truth-in-Lending Act (TILA), the Fair Credit Reporting Act (FCRA), the Real Estate Settlement Practices Act (RESPA) and related Connecticut state laws. Fraud Litigation: This portion of the Commercial Litigation Department's practice focuses on the representation of our clients in real estate "flip" schemes and other misconduct – including negligence, fraud and breach of contract – by and between loan brokers, real estate appraisers, attorneys, sham purchasers and settlement agents. Bankruptcy: This portion of the Commercial Litigation Department's practice focuses on the protection of our clients'/creditors' rights against bankrupt debtors, including bankruptcy case monitoring, proof of claim filing and prosecution, objecting to debtor discharge and dischargeability of debts and prosecuting and defending adversary proceedings. Insurance: This portion of the Commercial Litigation Department's practice focuses on the protection of insured client's rights under property and casualty, title insurance, errors and omissions, and directors and officers insurance policies. Miscellaneous: This portion of the Commercial Litigation Department's practice focuses on the representation of small businesses and individuals in variable commercial cases, including breach of contract, collections, commercial landlord-tenant disputes, corporate director and officer liability and corporate governance.
